The presenters will provide a brief overview of the circumstances under which a lawyer can be held liable to a non-client, with a particular focus on non-client claims arising in the litigation context (malicious prosecution, abuse of process, defamation, fraud, misrepresentation, illegal acts, etc.). The presenters will then discuss absolute privilege, what it covers, and its implications for lawyer liability to non-clients in the litigation context. The presentation will conclude with some helpful tips from the presenters on how to minimize potential liability to non-clients in the litigation context.
