Judy Selby Discusses Cyber Fraud Coverage Decision in Law360 "Biggest Insurance Rulings From The 1st Half Of 2021" Story

In the article, Selby discussed a Fifth Circuit decision that found the policyholder could not tap into a $1 million computer fraud provision in its crime policy because coverage was only triggered if the fraud took place without the company's "knowledge or consent." In the cyber fraud at issue, policyholder employees had themselves directed cash transfers to fraudsters.

Selby said the Fifth Circuit's decision shows that courts honor the plain meaning of insurance policy language. She also noted it is incumbent on companies to examine their cyber and privacy exposure and get the right coverage for it.
