John Ryan Discusses What Amy Coney Barrett’s Nomination Could Mean for the ARM Industry and the TCPA

Hinshaw partner John Ryan recently was quoted by ACA International in a story that explored the potential ARM industry impact of Amy Coney Barrett joining the U.S. Supreme Court. President Trump named Barrett as his nominee to replace Justice Ruth Bader Ginsberg, who passed away in September.

Ryan provided the following analysis of Judge Barrett:

"She is smart, thoughtful and well-prepared. Her rulings in consumer cases have often focused on the plain language of the statutory text. An example of her interpreting the FDCPA and the FCRA can be found in Walton v. EOS CCA , 885 F.3d 1024 (7th Cir. 2018). [Judge] Barrett applying the plain language of the TCPA should prove helpful to Facebook’s position on what constitutes an ATDS."
