Aimee Delaney Discusses New Illinois Collective Bargaining Amendment in Chicago Tribune
Hinshaw partner Aimee Delaney was quoted in the Sunday edition of the Chicago Tribune on the subject of the recently approved ballot measure that would enshrine collective bargaining rights in the Illinois Constitution. Delaney commented on whether gig workers and independent contractors would qualify as employees under the amendment.
Delaney said that any effort to organize independent contractors under the new amendment would likely be met with court action. Pointing to the fact that the amendment used the term "employees," not "workers" or "individuals," Delaney said "that (amendment) language would have to change," since an independent contractor is not an employee.
"Courts, bargaining table the likely next fronts in battle; Workers' rights amendment has both sides edgy," was published on November 20, 2022 by the Chicago Tribune.
