Dave Schultz Discusses D.C. Circuit's Takedown of FCC Robocall Rules

March 20, 2018

Hinshaw's Dave Schultz was recently featured in a CNET article titled "Court nixes FCC rules targeting robocalls," that discusses the recent decision by the D.C. Circuit to reject Federal Communication Commission (FCC) rules providing for an expanded autodialer definition—also known as "robocallers"—because it was too broad.

Schultz said he expects the decision to have a significant impact on litigation. "[The ruling] will make it much harder for people to sue under the TCPA because the scope of what is an ATDS (auto-dialer) has been significantly narrowed," he said.
