With the impending compliance date of September 23, 2013, for the HIPAA Final Rule fast approaching, it is important that health care providers and business associates have a clear understanding of the breach notification requirements and the HIPAA Privacy and Security Enforcement Provisions. The presenters will discuss the revised breach notification rules, including the four factors to consider when undertaking a risk analysis to determine the probability of a breach. They will also discuss the strengthened enforcement provisions — including the penalty provisions for non-compliance, the investigative procedures permitted, and the ability of the Secretary of HHS to conduct a compliance review.
