David Levitt Argues a Paradigm Shift is Underway at the Intersection of Electronic Medical Records and E-Discovery

Chicago-based partner David Levitt, an intellectual property attorney, recently published an article on Healthcare Informatics titled, "EMR and E-Discovery Is Coming: Are You Ready?" In the article, Levitt argues that a paradigm shift is underway with regard to the intersection of electronic medical records (EMR) and the e-discovery process in a medical malpractice case.

Levitt describes how plaintiff lawyers have begun asking for "audit trails" from the electronic record. However, he suggests these audit trails are only scratching the surface of potentially important information contained in EMRs. "The issues are only beginning to emerge, and there are no answers yet," Levitt said, "EMRs present new challenges, and healthcare institutions should look ahead to meet them."
