Anthony Antognoli Weighs in on What's Next After ACA Repeal Failure

August 7, 2017

Anthony Antognoli – a Chicago-based labor and employment partner at Hinshaw & Culbertson LLP – was quoted in a Law360 article titled "Attys Predict Next Steps After ACA Repeal Failure." The article presents a series of perspectives and predictions by attorneys reacting to the failure of Congress to approve the Affordable Care Act (ACA) repeal.

Here is Antognoli's perspective:

"As the recent health care reform proposals were focused on the individual market and Medicaid, we do not expect any legislative changes to employer group medical plans anytime soon. While there may be some regulatory changes on the horizon, employers who are heading into their 2018 renewals should not expect to see major changes to their current offerings. However, employers will want to monitor the upcoming debate over comprehensive tax reform. Depending on how tax reform unfolds, employers may need to re-think their compensation and benefits structure, including their medical plan offerings. A change in the exclusion from gross income for employer-provided health insurance would have a massive impact on how employers provide benefits to their employees."
