On Thursday, June 20, 2019, a group of Hinshaw attorneys—Jason Winslow, Danielle Costello, Roy Bossen, and Linda Horras—presented a workshop for members of the Illinois Critical Access Hospital Network (ICAHN). Attendees for the event included compliance officers and human resources professionals from ICAHN member hospitals.

Hinshaw Health Law partner Roy M. Bossen featured as co-author of a recent Law360 Expert Analysis article. The article, titled "CMS Medical Staffing Rule Leaves Questions Unanswered," discusses the rule's ambiguity relating to how medical staffs in a multihospital system may either opt in or opt out of the unified and integrated medical staff.

On November 5, 2021, the Centers for Medicare & Medicaid Services (CMS) issued an emergency regulation, requiring the workforce of Medicare- and Medicaid- certified providers and suppliers to be fully vaccinated against COVID-19 in order for Medicare and Medicaid facilities to continue participation in those programs. Noncompliance with the emergency regulation may result in the termination of Medicare and Medicaid provider status and could also subject providers and suppliers to civil monetary penalties and denial of payment.

At hospitals throughout the country, doctors, mid-level providers, and nurses have been standing shoulder-to-shoulder with retired medical providers, volunteers, and even medical students on the front lines to battle the deadly COVID-19 pandemic. While aggressive medical management, social distancing, and quarantining has effectively flattened the curve in many areas of the United States, the healthcare industry is now confronted with a new set of challenges as it begins resumption of elective surgeries and an expansion of service offerings. In addition to hospitals, many ambulatory surgery centers, physician practice groups, and dental offices have now begun expanding patient care. The Centers for Medicare and Medicaid Services (CMS) recently issued recommendations regarding reopening facilities to provide non-emergent, non-COVID-19 health care. CMS recognizes that as states and localities begin to stabilize—particularly for many areas that have a low, or relatively low and stable incidence of COVID-19—there is a need to restart care that is currently being postponed.
