Hinshaw & Culbertson LLP partners James M. Hofert, Roy M. Bossen, and Michael A. Dowell authored an article in Electronic Health Reporter titled "Risk Management Concerns Arising Out of HITECH and the Hospital Re-Admission Penalties Program."
The article discusses the various regulatory, legal and risk management concerns that are being raised due to the Health Information Technology for Economic and Clinical Health Act (HITECH) and the Hospital Re-Admission Penalties Program.
Various concerns are raised in the article by the Hinshaw group, including how the electronic records will take into account different medical complexities for each individual, as well as social and economic factors that affect the patients discharge. Other issues raised question the interoperability of the different software systems and the various problems of transitioning from paper to electronic systems.
Recommendations are made that all parties involved in this process (general counsel, healthcare providers, IT and clinicians) need to work very close together throughout the process to implement standards, procedures and systems to manage the different financial and liability risks involved.
