Hinshaw attorney Patrick Pumphrey recently authored a byline in the Daily Business Review discussing how Florida House Bill 837, "Civil Remedies," changed the state's civil litigation landscape by aiming to reduce frivolous lawsuits and associated abuses in personal injury actions.
Key provisions of the bill included modifications to bad faith law, reduction of the statute of limitations, adjustment of contributory negligence, and establishment of additional standards for calculating medical damages.
Pumphrey notes there was an influx of thousands of personal injury lawsuits filed just before the bill took effect on March 24, 2023, which significantly burdened the Florida court systems. This sudden surge resulted in a backlog of cases, posing administrative challenges for both plaintiffs and defense attorneys alike.
He further describes how the Florida Supreme Court responded by implementing case management orders and how mediation has emerged as a viable solution that offers a confidential and impartial platform for parties to negotiate and resolve disputes outside of court.
