Representative Experience

• Medical Device MDL Leadership: As national coordinating counsel for a medical device company in multidistrict litigation (MDL) arising from the use of a tubeless insulin pump to deliver subcutaneous drug therapy, guided the client through complex legal challenges, minimizing disruption to their business.
• Fire Loss Mitigation: Defended a global technology and manufacturing company in a $500K+ fire loss claim involving the destruction of an office building due to a fire that began in a deep fat fryer manufactured by our client, securing a jury verdict in favor of our client.
• Multijurisdictional Flavor Distributor Defense: Served as national coordinating and trial counsel for a leading food and beverage flavor distributor, managing approximately 60 multijurisdictional product liability cases across 11 states and over a period of eight years, a very challenging legal landscape where the products at issue were also under close scrutiny by regulatory authorities, government agencies, and research scientists in the academic community.
• Toxic Exposure Defense: Successfully defended three chemical manufacturers and one chemical distributor in consolidated cases involving approximately 35 plaintiffs alleging injuries from ethylene oxide gas exposure in a hospital instrument sterilization unit, securing summary judgment for our clients during pre-trial motion hearings.
• Wrongful Death Defense: Won summary judgment for a chemical manufacturer in a complex wrongful death suit in which the estate of a truck driver asphyxiated while attempting to remove residual glue containing trichloroethylene from a tanker truck brought claims for strict liability, negligence, breach of warranty, and distribution of unavoidably unsafe and hazardous materials against the trucking carrier, glue manufacturer, and manufacturers of the ingredients comprising the glue. The court granted summary judgment, ruling the client had no duty to warn plaintiff under any pleaded theory.
• Medical Device Deceptive Business Practices Defense: Successfully defended a Swiss medical device manufacturer in federal court against claims by a physicians group of deceptive business practices, breach of contract, and breach of warranty relating to a specialized piece of medical equipment by successfully contesting jurisdiction.
• Baby Bottle Class Action Defense: Successfully defended a leading manufacturer of plastic baby bottles in a class-action lawsuit involving allegations of injuries resulting from the ingestion of Bisphenol-A (BPA).
• Recycling Machine Modification Case: Represented an engineering company in a dispute involving an altered recycling machine. The appellate court subsequently affirmed the application of foreign law. Practitioners have since used this case as an example of the requirements for advancing a several-liability and phantom-defendant defense.
• Mass Tort Coordinating Counsel: Served as national coordinating counsel for a medical device company in mass tort litigation arising from using a pain pump to deliver medication to the shoulder following arthroscopic surgery.
• Adhesive Manufacturer Defense: Successfully defended a leading manufacturer of adhesives for fasteners used in the recreational vehicle industry in a suit seeking millions of dollars in damages for tortious interference with contract and intentional interference with business relationship litigated in federal court. Summary judgment was entered in favor of the client at the conclusion of discovery and shortly before trial.
