• Rapid Response in Catastrophic Accident Defense: Mobilized emergency response team following a six-vehicle accident involving a tractor-trailer carrying maximum DOT tire loads and an admittedly distracted employee driver. The case was successfully resolved for all occupants, avoiding punitive damage claims against the trucking company.
• Defending Against Nuclear Verdicts: Secured summary judgment for a driver involved in an accident caused by a co-defendant experiencing hallucinations. Successfully demonstrated that the driver acted reasonably under the unexpected conditions and eliminated liability exposure by proving no evidence supported the driver as the proximate cause of the plaintiffs' injuries.
• Technology Litigation Prowess: Represented a trucking company in litigation involving Tesla's Advanced Driver-Assistance Systems (ADAS). Leveraging cutting-edge expert analysis, Hinshaw successfully shifted liability away from its client during mediation.
• Innovative Social Media Strategy: Use of innovative strategies and client-focused initiatives, including the use of social media tools that quickly and efficiently capture critical evidence about witnesses and parties for successful results in mediation, arbitration and trial.

• Multi-State Licensing Analysis for Credit Unions: Assisted credit unions with multi-state legal analyses of licensing requirements to acquire retail installment contracts executed in connection with motor vehicle sales from dealers.
• Conducting Due Diligence for Bulk Portfolio Purchases: Oversaw and conducted due diligence for automotive dealers and sales finance companies purchasing bulk portfolios of retail installment sales contracts. The firm ensured compliance with federal and state regulations while supporting commercial lending transactions for an auto finance client.
• Regulatory Advice on Commercial Vehicle Leases: Provided regulatory advice to a national bank client regarding licensing requirements for acquiring commercial motor vehicle and equipment leases.
• Best Practices for Labor Compliance During Acquisition: Hinshaw developed comprehensive labor compliance best practices while advising an international transportation corporation on employment issues related to its acquisition of a New England trucking company. This included addressing wage and hour regulations, employee retention strategies, and integration of workforce policies.
• Fight Against Fraud: Hinshaw secured permanent stay of arbitration in Bronx County, New York, on behalf of an underinsured auto liability carrier where the investigation discovered prima facie evidence showing an insurance fraud perpetrated by a claimant using a false identity. The claimant was demanding more than $1 million in damages for serious personal injuries. The court decision disposed of the case in its entirety because the claimant’s fraudulent conduct was not covered under the carrier’s policy.
