The law firm of Hinshaw & Culbertson LLP is pleased to announce that partner Vincent Rizzo has been appointed as Vice President of the LAGBAC Executive Board. Established in 1987, LAGBAC is Chicago's LGBTQ+ Bar Association and is one of the largest LGBTQ+ bar organizations in the country.

The Windy City Times provided media coverage of an event hosted by Hinshaw in Chicago featuring rugby player Nick McCarthy. McCarthy, who plays for the Chicago Hounds Major League Rugby team, shared insights into his personal story, triumphs, and challenges as an LGBTQ+ professional athlete.

Hinshaw partner Vincent Rizzo was recently featured on the podcast Real Time with IPELRA, a production of the Illinois Public Employer Labor Relations Association (IPELRA). In the episode, Rizzo discussed LGBTQ+ issues in the workplace and strategies for employers to ensure an inclusive workspace.

Last month, the Supreme Court of the United States reached a historic 6-3 decision concerning the rights of LGBTQ+ employees. In its ruling, SCOTUS determined that sexual orientation and transgender status discrimination is a form of sex discrimination, which is protected under Title VII. Specifically, the Court found that "homosexuality and transgender status are inextricably bound up with sex," and that "it is impossible to discriminate against a person for being homosexual or transgender without discriminating against that individual based on sex."

Anti-discrimination efforts are front and center for the Consumer Financial Protection Bureau. This is evident by the interpretive rule it recently issued relating to the Equal Credit Opportunity Act (ECOA) and Regulation B. The rule clarifies that the prohibition against sex discrimination in ECOA and Regulation B encompasses sexual orientation and gender identity discrimination. The prohibition includes discrimination motivated by perceived nonconformity with sex-based or gender-based stereotypes, as well as discrimination based on an applicant's associations.

In a historic 6-3 decision, the Supreme Court of the United States held that an employer who discriminates against an employee merely for being gay or transgender violates Title VII. 590 U. S. ____ (2020). This landmark decision provides LGBTQ+ employees across the nation protection from termination or other employment discrimination because of their LGBTQ+ status. The Supreme Court's decision resolved three cases: Altitude Express v. Zarda; Bostock v. Clayton County, Georgia; and R.G. & G.R. Harris Funeral Homes Inc. v. EEOC. Justice Gorsuch delivered the opinion in which Justices Roberts, Ginsberg, Breyer, Sotomayor, and Kagan joined. Justice Alito filed a dissenting opinion, in which Justice Thomas joined. Justice Kavanaugh also filed a dissenting opinion.

Diversity and inclusion will only become more important to employers in the coming years, a fact underlined by President Biden's recent executive order on workplace discrimination. Biden's order mandates all federal agencies to fully enforce Title VII and other laws that prohibit discrimination on the basis of gender identity or sexual orientation. Further, federal agencies must take all lawful steps to make sure that federal anti-discrimination statutes that cover sex discrimination prohibit discrimination on the basis of sexual orientation and gender identity.
