Steven W. Cutler Reviews a Florida Legislative Proposal that Would Authorize Use of "Electronic Wills"

Steven W. Cutler – a Miami-based partner at Hinshaw & Culbertson LLP who is a Florida Board Certified attorney in the specialty designation of wills, trusts and estates and whose tax, estate planning and tax probate practice includes the preparation of wills, trusts, and related estate documents – recently authored an article titled, "Florida Last Wills: From Onion Skin to the Cloud," that was published by the Daily Business Review. In his article, Cutler analyzes the recently proposed and amended Florida Electronic Wills Act. Under the bill, Florida would become only the second state in the United States to expressly authorize the use of "electronic wills."
Cutler explained that "if enacted, the act would not replace the existing Florida Probate Code, but would provide an additional method by which an individual could create a valid Florida last will and testament." Cutler also describes some public policy concerns over exploitation of a vulnerable testator and electronic record tampering. Whether other states in the United States would accept the validity of Florida electronic wills remains to be seen.
