Hinshaw attorney Mohamed F. Sweify recently wrote an article that was published in the September 2025 issue of the New York State Bar Association’s New York Dispute Resolution Lawyer, examining the historical and modern application of alternative dispute resolution (ADR) in Islamic and Arab cultures.
Mohamed explains that ADR in both cultures began with tribal customs and religious teachings, using methods like Sulh (the process of settlement) and Tahkeem (arbitration) to resolve conflicts. These approaches value personal relationships and social harmony, which often differ from Western methods that stress individual rights and strict legal rules.
In the article, Mohamed points out that understanding cultural differences is important for resolving disputes between people from different cultures. He suggests that combining the best parts of both traditions can lead to fairer and more effective ways to settle disputes.
Lastly, his article highlights the need for cultural awareness and personalization in resolving conflicts, and encourages legal professionals to use both traditional and modern methods when handling international disputes. Mohamed discusses how Western and Islamic systems can learn from each other, and how blending their strengths is especially helpful for lawyers and clients working across borders.
