Hinshaw's Steve Moore and Keti Mebuke authored a Law360 expert analysis titled "COVID-19 Triage Rules Raise Dilemmas For Health Providers." In the article, they discuss COVID-19 triage guidelines being adopted by hospitals and states across the U.S. that have come under scrutiny because of the legal and ethical challenges they pose for health care providers.

Steve Moore—a Chicago-based partner and leader of the National Health Care Group at Hinshaw—was quoted in an article published by Cook County Record titled, "Illinois courts review hospital tax exemptions, with millions in tax revenue, viability in the balance." The article addresses the ongoing issue about which Illinois hospitals networks and healthcare provider groups should pay property taxes.

Steve Moore—a Chicago-based partner and leader of the National Health Care Group at Hinshaw—was quoted in an article by Cook County Record titled, "Illinois Supreme Court to Decide if Hospitals Will Have to Pay Property Taxes." The article discusses the recent decision by the Illinois Supreme Court to hear arguments about whether hospitals should be exempted from paying property taxes under a bill signed into law in 2012. The Court had previously declined to rule on the issue in the Carle Foundation v. Cunningham Township case earlier this year.

Hinshaw partners Roy Bossen and Stephen Moore are scheduled to participate in four separate presentations during the 2023 Illinois Critical Access Hospital Network's (ICAHN) Annual Conference on November 29, 2023, in Champaign, Illinois. On November 5, 2021, the Centers for Medicare & Medicaid Services (CMS) issued an emergency regulation, requiring the workforce of Medicare- and Medicaid- certified providers and suppliers to be fully vaccinated against COVID-19 in order for Medicare and Medicaid facilities to continue participation in those programs. Noncompliance with the emergency regulation may result in the termination of Medicare and Medicaid provider status and could also subject providers and suppliers to civil monetary penalties and denial of payment.

Hospitals, physicians, and other health care providers are facing unprecedented ethical and legal challenges related to the shortage of critical-care resources for patients during the coronavirus pandemic (COVID-19). Some triage protocols adopted by hospitals and states have been criticized for devaluing people with disabilities and excluding them from "equal" treatment opportunities. Other protocols have hospitals and health care providers turning from a patient-centered approach to a "public health as a whole" approach. These protocols raise the question of whether they provide the necessary ethical and legal framework for health care providers to make these decisions.
