Steve Moore—a Chicago-based partner and leader of the National Health Care Group at Hinshaw—was quoted in an article by Cook County Record titled, "Illinois Supreme Court to Decide if Hospitals Will Have to Pay Property Taxes." The article discusses the recent decision by the Illinois Supreme Court to hear arguments about whether hospitals should be exempted from paying property taxes under a bill signed into law in 2012. The Court had previously declined to rule on the issue in the Carle Foundation v. Cunningham Township case earlier this year.
“After declining jurisdiction in Carle Foundation v. Cunningham Township, the Illinois Supreme Court will likely decide whether 2012 legislation providing for hospital property tax exemptions violates the Illinois Constitution," said Moore. "The ruling could finally give a clear path to property tax exemptions if the legislation is determined constitutional." If the law does not pass constitutional muster, then hospitals will once again face "turmoil and uncertainty" on the property tax issue, he added.
