Tuesday, April 20
Claims Handling Issues and Bad Faith Developments to be Aware of in 2021 | 12:00 – 1:00 p.m. CT

This panel will explain the traditional and emerging claims handling and legal issues in the Post-Pandemic world and evolving bad faith standards in state statutes and case law. Panelists will also discuss current legal standards, developments, and how to best try to make your claim file bulletproof from policyholders' and reinsurers' scrutiny and defend against the bad faith claim.

COVID-19 Claims | 12:00 – 1:00 p.m. CT

This panel will address the litigation landscape arising from recent lawsuits relating to claims seeking coverage for COVID-19-related losses under first-party and third-party policies. With respect to first-party policies, we will address issues relating to the insured's burden to prove physical loss or damage, business interruption, contingent time element, ingress/egress, and civil authority claims, and various exclusions which bar claims, including exclusions for virus and bacteria. We will also address issues relating to coverage for bodily injury and property damage liability and personal and advertising injury liability and exclusions in the policies, including the employers' liability, total pollution, communicable disease, fungi or bacteria, and organic pathogen exclusions.

Construction Claims: A Practical Reservation of Rights Checklist | 12:00 – 1:00 p.m. CT

Despite their prevalence, construction defect and personal injury claims continue to present nuanced considerations for claims professionals and attorneys preparing reservations of rights. This presentation will provide attendees with a practical checklist for their next construction claim. We will address, among many others, the following issues: the "written contract" requirement and other additional insured concerns; variations on the distinction between faulty work and damage to other property; what documents and information to request; and state-specific statutes and legal doctrines that may implicate coverage. You will leave with a checklist you can use immediately for your next reservation of rights.

Emerging Issues in Coverage for Cyber and Privacy Incidents | 12:00 – 1:00 p.m. CT

Cyber and privacy events were on the rise in 2020, impacting organizations of every size and industry vertical. These high-risk issues can affect insurers across multiple policy lines and across jurisdictions. In this session, we will discuss recent "silent cyber" coverage decisions, new and proposed cyber and privacy laws and exposures, and related coverage issues, including coverage for regulatory fines and penalties.
