Hinshaw Client Success Named Among "10 Most Popular Daily Decision Articles of 2023" by the Association of Credit and Collection Professionals (ACA)

A story on a significant Hinshaw client win—Quaglia v. SN Servicing, McCalla Raymer Leibert Pierce—ranked among the Top Ten most popular daily decision articles published by the Association of Credit and Collection Professionals (ACA) in 2023.
The Illinois state court case involved claims that the use of a third-party vendor by Hinshaw's client to print and mail communications violated Section 1692a(3) of the Fair Debt Collection Practices Act (FDCPA). This is well known in the ARMs industry as a Hunstein claim. The court ruled on the merits and rejected the Hunstein theory. Obtaining a ruling on the merits in this type of case had been exceedingly difficult for accounts receivable defendants prior to Quaglia. The case was successfully defended by Hinshaw partners Justin Penn and David Schultz.
