Tom McGarry and Tom Sukowicz Author Article on ABA Rules Prohibiting Discriminatory Conduct

Thomas P. McGarry and Thomas P. Sukowicz authored the article "Rules Prohibit Discriminatory Conduct Under Limited Circumstances," published by the Leading Lawyers Law Bulletin Law Day 2016 Edition.
The article addresses a recent American Bar Association (ABA) Standing Committee on Ethics and Professional Responsibility proposal to amend ABA Model Rule of Conduct 8.4 (Misconduct). The amendment would add a subsection to the rule providing that
it would be professional misconduct for a lawyer to knowingly harass or discriminate against persons on the basis of race, sex, religion, national origin, ethnicity, disability, age, sexual orientation, gender identity, marital status or socioeconomic status, while engaged [in conduct related to] [in] the practice of law.
In their discussion, the authors also address various court cases involving discriminatory conduct and states with similar conduct rules.
