Larry Golub was quoted in the article, "Ore. Defect Coverage Ruling Closes Loophole For Insurers," published by Law360 on September 23, 2016.
The article discusses how the Oregon Supreme Court refused to allow an insurance company to second-guess a jury’s finding limiting a policyholder's liability for construction defect damages. Experts say that this decision closes a loophole for carriers to "get a second bite at the apple" once the issue of liability has been decided in a case. Mr. Golub pointed out that the Oregon high court's decision doesn't prevent insurance companies from raising exclusions or other defenses to coverage. "While the court is correct that the carrier can't change what the insured was found liable for in the underlying liability trial, it also acknowledged that the carrier can definitely proceed with a subsequent action against the insured to litigate the coverage issues," he said.
