Jennifer Driscoll Anticipates Epic Battle Between “Titans of the Antitrust Bar”
Analyzing State AGs Challenge to Proposed Paramount-Warner Bros Merger

Hinshaw partner Jennifer Driscoll was quoted in Global Competition Review (GCR), offering insights into the major antitrust issues surrounding Paramount’s proposed acquisition of Warner Bros. A coalition of 12 state attorneys general is seeking to challenge approval of the $110+ billion merger.
Jennifer noted the dispute will pit some of the brightest stars in the antitrust firmament against each other: “We are talking about titans of the antitrust bar. This is going to be an epic battle.”
Jennifer also addressed the claims in the filing, telling GCR: “The complaint is well-crafted. It is thoughtful in its discussion of three distinct relevant markets and, at least on its face, appears to be grounded in well-established economic principles.”
Additionally, she discussed the plaintiff states’ litigation approach, noting that retaining outside counsel from Milbank suggests a likely trial strategy rather than settlement: “They did not retain the consummate settlement attorney strategist. They retained someone who knows how to win a trial.”
