David Alfini and Adam Guetzow, Chicago-based attorneys in the Personal Injury & Property Damage Practice at Hinshaw & Culbertson LLP, authored the article "The Illinois Authorized Electronic Monitoring in Long-Term Care Facilities Act—What It Means for Long-Term Care Providers in Illinois," which appears in BNA's Health Law Reporter. The piece addresses the trend of states passing laws allowing electronic monitoring of resident rooms in long-term care facilities. Messrs. Alfini and Guetzow frame their discussion around Illinois' Authorized Electronic Monitoring in Long-Term Care Facilities Act (Act). That statute was signed into law on August 21, 2015 and represents Illinois' most significant legislation on the subject. In the course of the article, the authors provide an in-depth analysis of: the Act and, generally, comparable laws; those statutes' implications and requirements; and how facilities falling within the purview of such laws (or similar ones passed in the future in other jurisdictions) might address legal compliance.
