Third Biennial Definitive Disability Conference

Hinshaw & Culbertson LLP will present the third biennial Definitive Disability Conference (DDC), October 12–13, 2017, in Boston, co-chaired by Robert Hess and Martin Rosen. The conference, of which Hinshaw is the lead sponsor, will focus on issues relating to the evaluation and litigation of disability claims, both with respect to disability income and long term disability policies.
The conference will kick off with opening remarks from Rosen. Peter Pederson will present on "LTD Overpayment Claims After Montanile: Are They Still Viable?," a presentation that will offer guidance for claim managers and counsel tasked with recovering overpayments under ERISA-governed plans in the wake of the U.S. Supreme Court's decision in Montanile v. Board of Trustees. Daniel Ryan will provide an ERISA disability case law update, in which he will discuss the most important cases from across the country. Jenny Wang will examine the trend of the ERISA plaintiff's bar increasingly seeking to conduct discovery outside of the administrative record in de novo review cases in her presentation titled, "Discovery in ERISA Litigation."
