About Pete
Pete’s commercial litigation practice runs the gamut from business disputes involving claims for breach of contract, fraud, and injunctive relief, to employee benefits disputes and high-exposure class actions. He has particular experience with disputes related to health plans and the federal and state laws governing them, as well as disputes arising from other employee benefit plans, whether governed by ERISA or state law. His work frequently involves the representation of insurers, third-party administrators, plan sponsors, and fiduciaries in disputes involving benefit denials, the reimbursement of in- and out-of-network medical providers, allegations of fraudulent or abusive medical billing practices, and the interpretation of managed care agreements, administrative-services-only contracts, and stop-loss policies.
Additionally, Pete counsels business owners on operating and employment agreements, and advises health benefits companies on compliance with state insurance codes. He has successfully resolved class actions under ERISA, the Telephone Consumer Protection Act (TCPA), the Biometric Information Privacy Act (BIPA), the Racketeer Influenced and Corrupt Organizations Act (RICO), and consumer fraud statutes.
Areas of Focus
Experience
- Secured the dismissal of an action by a medical provider seeking to hold a health plan administrator liable for millions of dollars in alleged underpayments for out-of-network emergency services.
- Secured an arbitration award determining that a claims administrator properly calculated and was entitled to retain deferred service fees under an administrative services agreement with an employer sponsoring a self-funded health benefit plan.
- Obtained summary judgment for a health plan administrator in a dispute with an out-of-network medical provider seeking millions of dollars in damages based on claims for promissory estoppel, common-law fraud, consumer fraud, and violations of the prompt-pay statute.
- Enforced a reinsurance treaty through a bench trial on behalf of a small health insurer, securing a judgment obligating the reinsurer to honor the treaty and reinsure medical insurance policies issued by our client, despite the reinsurer's failure to execute the treaty.
- Achieved a complete arbitration victory for a health plan administrator in a dispute where a large hospital system alleged breach of hospital services agreements due to unauthorized claim line edits to thousands of reimbursement claims.
