Scott Seaman to Address Fundamental and Emerging Issues in the Excess Insurance Arena

Scott Seaman, National Co-Chair of the Hinshaw & Culbertson LLP’s Insurance Services Group, will address fundamental and emerging issues at a Strafford live webinar, "Excess Insurer's Duty to Defend and Indemnify: Exhaustion, Claims Not Covered by Primary, Defense Cost Reimbursement," scheduled for Tuesday, August 9, 1:00 pm - 2:30 pm (Central).
The program will provide perspectives of experienced insurer on case law developments and key issues such as:
- Whether or when excess insurers may be obligated to reimburse the insured for defense costs—or assume the principal obligation to defend?
- Whether or when excess insurers may be obligated to contribute to a settlement if the primary policy has not in fact paid its full limits (sometimes referred to as the Zeig or functional exhaustion issue)?
- Will the insolvency of the primary insurer require an excess policy to drop down?
- How can counsel address exhaustion of primary coverage in mass tort or major liability litigation such that excess coverage is in play?
