About Eric
A seasoned trial attorney, Eric defends business clients in commercial litigation. He represents leading companies in the financial, technology, construction, and other industries in commercial contract disputes. Eric represents mortgage lenders and mortgage loan servicers in single-plaintiff and class action lawsuits related to their loan origination and loan servicing operations.
He also handles claims related to federal and state statutes, including the Real Estate Settlement Procedures Act (RESPA), Truth in Lending Act (TILA), Home Ownership and Equity Protection Act (HOEPA), Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), and the Credit Repair Organizations Act (CORA). Eric additionally advises clients on bankruptcy matters, including the defense of Bankruptcy Rule 2004 examinations sought by the US Trustee.
Eric’s litigation experience is often sought for complex claims, and he is known as a strategic, practical, and efficient litigator among his peers and clients.

Experience
- Relationship partner for one of the nation’s largest mortgage companies as one of its go-to outside litigation counsel for matters related to its mortgage origination and servicing operations. Hinshaw’s team also provides this client with federal and state compliance counsel and other strategic counsel as requested to assist in the continued growth and expansion of the company’s operations.
- Secured a win on behalf of the largest company operating an online property rental marketplace at the Florida Supreme Court, upholding the company's arbitration agreement. In a 6-1 decision, the Florida Supreme Court held that the incorporation of the AAA rules in the company's online terms of service was sufficient to establish that the parties "clearly and unmistakably" agreed that the arbitrator would decide the threshold question of arbitrability.
- Represented employees of a national heavy equipment sales and rental company in suits brought by their former employers alleging violation of a non-compete agreement and theft of confidential and proprietary information and trade secrets.
- Represented a solar power company in various lawsuits, including a $40 million contract dispute with its business partner, a consumer class action brought by its customers, sales and use tax lawsuits brought by two municipalities, and a $30 million lawsuit seeking refundable tax credits from the state.
