After conducting a retrospective review of existing federal regulations, the Centers for Medicare & Medicaid Services (CMS) has issued two final rules aimed at eliminating regulations on hospitals and other health care providers that have become unnecessary, obsolete or overly burdensome. These rules were issued in response to Executive Order 13563, in which President Obama called upon various federal agencies to “modify, streamline, or repeal” regulations that have become outmoded or impose unnecessary burdens. The first rule updates the Medicare Conditions of Participation (CoPs) for hospitals and critical-access hospitals (CAHs). The second, known as the Medicare Regulatory Reform rule, impacts both hospitals and other providers/suppliers of health care, including ambulatory surgical centers. Both rules will become effective 60 days from the date of their publication in the Federal Register.

On December 30, 2009, the U.S. Department of Health and Human Services (HHS) issued two sets of regulations that clarify how eligible health care providers can receive federal financial subsidies for their adoption and meaningful use of electronic health record (EHR) technology. The regulations outline the proposed provisions governing EHR incentive payment programs under the American Recovery and Reinvestment Act of 2009 (ARRA). Under the ARRA, eligible professionals, eligible hospitals, and critical access hospitals that participate in Medicare and Medicaid and that are meaningful users of certified EHR technology can receive incentive payments for their efforts to adopt, implement or upgrade certified EHR technology, or for meaningful use in the first year of their participation in the program and for demonstrating meaningful use during each of five subsequent years.

On May 28, 2021, Illinois Governor J.B. Pritzker signed an amendment to the Illinois Code of Civil Procedure, 735 ILCS 5/2-1303, that applies a 6% prejudgment interest rate on all damages awarded in personal injury and wrongful death cases. Starting July 1, 2021, all personal injury and wrongful death actions will begin to accrue prejudgment interest from the date the action is filed or July 1, 2021, whichever date is later. Prejudgment interest accrual is limited to five years.

In a legal malpractice action arising out of revisions to a client's estate plan, the appellate court considered whether an attorney has a duty to evaluate a client's mental capacity and, if so, whether the plaintiff alleged sufficient facts to show the defendants (a law firm and its attorneys) were aware of their client's disability at the time they provided legal services.

The First District Appellate Court in Illinois affirmed the trial court's denial of a defendant law firm's motion to compel arbitration on the basis that the arbitration provision in the "Attorney-Client Agreement" entered into with plaintiff in the underlying personal injury action was procedurally unconscionable. The court ruled that plaintiff could not be held to an agreement to arbitrate a legal malpractice claim "without being informed about the scope and effect of the agreement."

In states with Financial Elder Abuse statutes, legal malpractice claims by seniors invoking those statutes are common. These laws are generally understood to address the conversion of property of elderly or dependent adults based on undue influence or duress. In fact, liability can usually be established based on a showing of any wrongful taking of the elder's property.[1]
