Hinshaw partner Scott Seaman will co-present the BARBRI CLE webinar, "Allocation of Liability and Exhaustion of Policy Limits: Policyholder and Carrier Perspectives," on February 10, 2026. The program will address the complexities of allocating indemnity across multiple policy periods, insurers, and lines of coverage, as well as the impact of policy stacking.
The session will also examine allocation challenges that arise when a single matter touches D&O, E&O, and CGL policies, and how disputes develop when parties disagree about responsibility for payment and the sequence of coverage. Speakers will explain when vertical and horizontal exhaustion applies and how excess policies may be triggered.
The panel will review issues arising from primary insurers settling below limits and the considerations that affect access to excess coverage. Attendees will gain insight into current developments, key policy language, and practical strategies for resolving priority of coverage disputes involving allocation and exhaustion.
