Hinshaw’s Jack Shadid will present an American Bar Association (ABA) CLE webinar on December 12, 2025. His program, "Reducing Barriers to Commerce: Blockchains, Cryptocurrency, and Article 12 of the Uniform Commercial Code," will explore a new regulatory framework adopted by at least 25 states that governs the use of cryptocurrencies and other digital assets in secured transactions.
Bitcoin's introduction created a largely unregulated online marketplace that was inaccessible to many. Since then, advancements in both technology and the law have broadened access to the digital economy. In 2022, the Uniform Law Commission and the American Law Institute approved Article 12 of the UCC, which establishes a legal structure for resolving disputes involving cryptocurrencies and other blockchain-based assets.
Previously linked primarily to online darknet markets like the Silk Road, cryptocurrencies have now become an essential exchange for major businesses, as highlighted by the FTX bankruptcy. The new UCC framework enhances certainty for companies and clarifies court guidance in cases of conflict.
