A New York federal judge has confirmed a trial victory that Ed Lenci and Ben Noren of Hinshaw's New York office won for Conduent State & Local Solutions, a subsidiary of Conduent, Inc., one of the world's largest providers of business process services, or BPS. AiNet Corp., which operates a colocation facility in which Conduent housed its customer's back-up servers, claimed both that Conduent improperly invoked a "termination for convenience" provision of their subcontract after Conduent's customer decided to re-assign AiNet's work to another colocation facility and that AiNet never received Conduent's cancellation of additional power for the back-up servers. Conduent prevailed after two days of trial. Download a copy of the court's trial decision and a copy of the court's denial of AiNet's motion for reconsideration.
