Hinshaw Insurance Law Radio: A Discussion of Key Insurance Decisions in 2018 and Cases to Watch in 2019 with Reporter Jeff Sistrunk

In the latest episode of the Hinshaw Insurance Law Radio podcast, host Scott Seaman, a Chicago-based partner and co-chair of the national Insurance Services Practice Group, talks with Jeff Sistrunk, senior insurance reporter for Law360, about some of the key insurance coverage decisions that took place in 2018, as well as cases to watch in 2019.
At the top of Jeff's list for key cases in 2018 is KeySpan v. Munich Re, perhaps the most talked about insurance decision from the past year. Jeff and Scott also discuss two federal appellate court decisions—in the Second and Sixth Circuits—involving coverage claims for losses due to email-based "phishing" theft schemes. The final case they discuss from 2018 was the Ohio Supreme Court decision Ohio Northern University v. Charles Construction, which addressed the issue of whether construction defects constitute an accident or occurrence.
For cases to watch, Jeff and Scott then review Keodalah v. Allstate, a Washington Supreme Court case on the issue of whether insurance adjusters can be found individually liable for bad faith and breaches of consumer protection laws. They also discuss the Connecticut case of RT Vanderbilt v. Hartford, which deals with the issues of trigger, allocation, and unavailability of insurance coverage, and the Pennsylvania case of Erie Insurance Exchange v. Moore, which grapples with the outer limits of what constitutes an accidental "occurrence."
