Appellate Spotlight: Client GeoVera Secures Florida Appellate Court Affirmation of Summary Judgment Win Over Limited Water Damage Exclusion

Taylor Bowman and Steven Lehner recently secured a win at the Florida Sixth District Court of Appeal, on behalf of insurer GeoVera. At issue was a coverage claim filed by a homeowner policyholder involving alleged property damage resulting from a broken refrigerator water line.
The policy in question featured a series of coverage limitations, including a water damage limitation and exclusion endorsement, and other restrictive endorsements. GeoVera moved for summary judgment, arguing the loss was excluded under the policy's limited water damage exclusion. The trial court agreed and granted GeoVera's motion for summary judgment.
On appeal, the Sixth District Court of Appeals affirmed the trial court's summary judgment ruling.
This is the third win Hinshaw has helped client GeoVera secure in 2023 involving the application of a limited water damage exclusion.
The case is Guy Bradstock v. GeoVera Specialty Insurance Company, case number 6D23-370, in Florida's Sixth District Court of Appeal.
