What Comes Next for TCPA Litigation? David Schultz quoted in American Lawyer

Hinshaw partner David Schultz, a nationally recognized consumer litigation defense lawyer, was quoted in an American Lawyer article by reporter Roy Strom regarding future prospects for claims filed under the U.S. Telephone Consumer Protection Act (TCPA). According to Strom's article, TCPA claims filed in federal court grew from less than 100 in 2009 to a record 4,860 last year.
Schultz spoke to speculation that a business-friendly President Trump and a Federal Communications Commission now chaired by Republican appointee Ajit Pai might together seek to blunt TCPA class actions. "It's a reasonable expectation that based on [Pai now taking over as] chairman and given the likely makeup of the commission that they'd probably take a more restrictive view of the TCPA than previously," he said.
