Hinshaw attorney Wendy Chang reviews some of the key 2016 California lawyer conflicts decisions in a Daily Journal article. In particular she reviews the decisions in Costello v. Buckley, In re Marriage of Murchison, M'Guinness v. Johnson and Ontiveros v. Constable.
The cases focus on motions to disqualify due to access to confidential information of a former client; whether disqualification is a "disfavored remedy;" and whether a single counsel can represent both the corporation and the majority shareholder in defending derivative litigation brought by a minority shareholder.
