Steven Puiszis Discusses Due Diligence Significance of Judicial Orders Requiring Law Firms to Disclose Use of Generative AI Tools

Hinshaw partner Steven Puiszis discussed with LegalTech News Online the significance of several recent judicial orders requiring attorneys to disclose their use of generative AI tools in connection with any legal court filings.
Puiszis stated that "If there's a proper vetting done upfront when you're considering different options, a firm should know which tools they have in their toolbox that use artificial intelligence." However, some firms may not track that information in their record keeping process.
He adds that as more orders follow, firms may need to utilize a more thorough record keeping process. "Whether or not they previously saw a need to compile records showing which tools utilize artificial intelligence (or generative AI) and which do not, ... some may not have had that realization at the time of the initial vetting. But as we see more and more of these orders, firms may need to start doing that" and tracking which tools use AI and/or generative AI, Puiszis said.
