Scott M. Seaman, a Chicago-based partner and co-chair of the national Insurance Services group at Hinshaw & Culbertson LLP, was quoted in the article, "Del. Ruling Adds Wrinkle To NY Coverage Trigger Law," published by Law360 on September 14, 2016.
The article discusses a Delaware Supreme Court opinion that a trial court had erred in holding that two pump manufacturers could pursue coverage only under excess policies that were in effect when the plaintiffs in underlying asbestos personal injury cases were first exposed to asbestos, or what is known as the "exposure trigger" of coverage.
Mr. Seaman comments on the rule stating "It is difficult to believe that the Delaware Supreme Court's decision on New York law will provide a meaningful star to steer by with respect to other asbestos coverage matters, much less other types of claims. In some respects, it may fuel some uncertainty and additional litigation. Even in the context of asbestos claims, parties likely will have as many ways to distinguish the case from their cases as there will be to analogize it."
