Proposed Federal American Privacy Rights Act Offers a Positive Path Forward

Cathy Mulrow-Peattie was quoted in Law360 discussing The American Privacy Rights Act (APRA), a bipartisan Congressional proposal to create a national data privacy framework in the United States.
The legislation seeks to unify the current patchwork of state privacy laws under a single national standard, proposing provisions for data minimization, consolidating the definitions for sensitive data, preemption of state privacy laws, and the right for consumers to bring private lawsuits.
Mulrow-Peattie noted:
"This bipartisan, bicameral privacy bill puts the U.S. on a positive path towards our ultimate goal that would provide our citizens a federal privacy right [and] preemption of the growing quagmire of differing state privacy laws which are costly and difficult for organizations to comply with."
The increase in state privacy laws and a growing concern over privacy and artificial intelligence development have added to the proposal's urgency and relevance. However, significant legislative and political hurdles remain.
