The article discusses how a three-judge panel of the appellate court upheld an Arkansas federal court's ruling that MMIC can void the coverage it issued to Dr. Karl Hasik in connection with his work at Crawford County Memorial Hospital in Denison, Iowa. The article mentions that Ms. Sarp represented MMIC Insurance Group in which MMIC sought to rescind a professional liability policy issued to a physician who failed to disclose two potential malpractice claims on his application and then, after his application was submitted but before "prior acts" coverage was issued, was served with a lawsuit arising out of his prior practice and failed to report that to MMIC. The Eighth Circuit agreed with MMIC that this statute did not apply in a situation in which a material change in circumstances arises after the application is submitted but before coverage is issued.
