On Thursday, November 9, the ARIAS•U.S Fall Conference is set to open in New York. Hinshaw is a proud sponsor of the conference. Coinciding with the conference, the Q4 2023 edition of the ARIAS•U.S Quarterly newsletter has also been published. The edition includes a byline by Hinshaw partner Ed Lenci, who currently serves as the co-chair of the ARIAS•U.S. International Committee.
In the article – a version of which was published by the New York Law Journal last September – Lenci examines the prospects for the Second Circuit's reconsideration of its previous holding that the McCarran-Ferguson Act (MFA) reverse-preempts the New York Convention such that state prohibitions on the arbitration of disputes between the policyholder and their insurers control over the Convention's pro-arbitration policy.
"Insurers and Reinsurers, Here and Abroad, Should Pay Attention." was published by the ARIAS•U.S Quarterly, Q4 2023 Edition
