Mitchel Chargo Profiled in Higher Law Newsletter, Discusses Minnesota Cannabis Licensing and Regulations

Hinshaw partner Mitchel Chargo was featured in an exclusive Q&A profile published by Law.com's Higher Law newsletter column. In a wide-ranging discussion, Chargo addressed questions about the regulatory landscape of the cannabis business in Minnesota, licensing categories and requirements, and common issues clients are facing in the industry.
Chargo noted that vertical integration in Minnesota's cannabis business has been prohibited. "There are a few licensed classes that by their very nature will allow for seed-to-sale." he stated. "[W]hat I’m telling people, individuals and companies that are calling me from outside the state and even from inside the state, is that you have to pick the sandbox you want to play in very carefully."
Chargo added that clients should consider their city council's stance on zoning. He explained that Minnesota's new cannabis legalization law prohibits local governments from banning cannabis businesses within their jurisdictions but allows them to regulate the time, manner, and place of operations.
