Mitchel Chargo Appears on the KQRS Morning Show, Discusses the Legalization of Adult-Use Cannabis in Minnesota

Hinshaw partner Mitchel Chargo was a featured guest on the KQ Morning Show of KQRS Radio this week. Chargo discussed with hosts Steve Gorman (the founding member of the legendary Black Crowes) and Brian Zepp the legalization of recreational adult-use cannabis in Minnesota, effective August 1, 2023. Chargo discussed the various licensing categories and requirements, remaining questions on the legal implications of decriminalization in the state, and jurisdictional regulations.
Chargo explained that there are sixteen classes of licenses in Minnesota and that the state has banned vertical integration or "seed to sale" except in limited circumstances. He added that he tells businesses "that want to get in line for licenses to pick the sandbox you're going to play in very carefully because choosing one type of a license may preclude you from having a different kind of license."
Chargo also stated that under the state legalization law, municipalities cannot ban canna-businesses nor can they prohibit the use of cannabis in their jurisdiction, but they can determine the "time, manner, and place of operation" or zoning.
