Kristen Perkins and Paige Newman on Continuing Absence of DOJ Guidance on ADA Website Accessibility Requirements

Ft. Lauderdale-based partner Kristen Perkins and associate Paige Newman authored an article published by Daily Business Review titled "Website Accessibility Landscape Continues to Lack Clarity as Businesses Await Guidance." The article discusses the Website Content Accessibility Guidelines (WCAG) which courts currently use to assess compliance with the ADA, as the Department of Justice (DOJ) has yet to provide more concrete guidance. Website accessibility continues to be a source of extensive litigation throughout the United States.
"Despite the lack of DOJ activity in this area," Perkins and Newman noted, "there is legislation currently in committee that would instruct the DOJ to take action to adopt web accessibility guidelines in fiscal year 2019." Even without concrete action from the DOJ, Perkins and Newman encourage business to be proactive and ensure their websites continuously comply with the newest standards—namely the WCAG 2.1—in order to reduce the risk of protracted litigation.
