Hinshaw partner Judy Selby recently joined host Don Tergler on the Insurance Journal's Insuring Cannabis Podcast. In the discussion, she acknowledged that many cannabis business are small or startups, and may not wish to invest their limited resources into cyber security and privacy compliance. She also noted another factor unique to this industry, namely a potential unwillingness to report incidents of cyber crime to law enforcement.
Notwithstanding, she noted that cannabis dispensaries in particular have a very high level of cyber risk, due to their "seed-to-sale" tracking obligations, which implicate PHI, PII and PCI information. She also noted these compliance risks are compounded when a business conducts commerce online or via an app. Finally, Selby also discussed third party risk management and supply chain risks.
