Hinshaw attorney Joanna Storey recently authored a blog post titled "Beware of web beacons that can secretly monitor your email." Published by the Bar Association of San Francisco's (BASF) Legal by the Bay blog, the post discusses the ethical issues for lawyers in connection with the use of web beacons—a tracking software embedded in a logo or other image—in emails.
Storey explains that a number of jurisdictions have weighed-in on the issue and determined that lawyers may not ethically use tracking devices to monitor email. She also notes that California has yet to take a stance on the issue, but that the California Rules of Professional Conduct lay a foundation to prohibit attorney use of such technology.
