Earlier this year, the Illinois Institute of Continuing Legal Education published the latest edition of Wrongful Death & Survival Actions in Illinois. Originally conceived for IICLE in 1992 by Hinshaw & Culbertson LLP partner Scott Seaman, who continues to serve as the publication's general editor, this handbook is now in its 5th edition and continues to serve as an important resource for practitioners. It is a one stop source for the substantive law, evidentiary rules, and damages parameters needed for successfully prosecuting and defending wrongful death and survival actions. It provides insights and useful guidance throughout the life of the case from case intake and evaluation, to pleadings, to discovery, to trial preparation, and through the trial. The book's appendix also includes examples of draft pleadings, draft discovery, and useful checklists that can be tailored for your use (including pre-filing considerations, claim information requirements, potential defenses, deposition preparation, and trial preparation lists).
Scott also co-authored Chapter 1 Wrongful-Death Actions and the Illinois Wrongful Death Act; Chapter 2 - Damages in Wrongful-Death Actions; Chapter 5 — Family Member Liabilities, Remedies, and lmmunities; and Chapter 7 — Appendix.
