Hinshaw's Craig Liljestrand has published his latest Chicago Daily Law Bulletin (CDLB) column. Titled "Asbestos verdict reversed for failure to warn," the article examines the decision in McKinney v. Hobart Brothers Co., 2018 IL App (4th) 170333.
The Fourth District Appellate Court of Illinois' reversal of the McLean County Circuit Court's verdict involved claims by a welder that he developed mesothelioma following exposure to welding rods containing asbestos, because the defendant had "willfully and wantonly, or at least negligently," failed to warn of the dangers of the product. Liljestrand explains how the Fourth District determined that the defendant was entitled to judgment notwithstanding the verdict.
