Hinshaw's Craig Liljestrand has published his latest Chicago Daily Law Bulletin (CDLB) column. Titled "Plaintiff wins dispute over forum; Cook County deemed best for all," the article examines Alley v. BNSF Railway Co., 2019 IL App (1st) 182509-U.
The First District Appellate Court's affirmation of a Cook County Circuit Court judgment in a wrongful-death suit involved a brakeman and locomotive engineer who worked for BNSF for over 40 years and died of lung cancer. Liljestrand explains how the First District determined that the trial court had not abused its discretion in denying an intrastate forum non conveniens motion.
