Cheryl Wilke was interviewed on Talk Radio 790 KABC on Friday, January 2, 2015. In the radio interview, Ms. Wilke discusses employment related lawsuits and litigation in the state of California and how wage and hour, and sexual harassment retaliation suits have become a near epidemic for California employers.
Ms. Wilke also discusses how state law is extremely aggressive in California, and how in the years between 2008 and 2010, employers and companies moved their establishments of the state to other states such as Idaho and other southern states where the state laws were more palatable to employers.
She also discusses how employers can purchase an employers professional liability policy (EPLI) that provides insurance coverage for employers who perform negligent acts that do not appear to violate the law, however such coverage can help protect employers from litigation, but the deductibles associated with such coverage is costly.
Ms. Wilke also comments on recent cases where employers have been accused of wrongful doings. She discusses how the credibility of those employee accusations are important to each case, and also discusses how there is little to no recourse for employers for recovery of costs for frivolous claims in the state of California.
